This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Geo-Comm, Inc. (“we,” “us,” “our,” or “GeoComm”).
This Privacy Policy, along with our Terms of Use governs your use of our website at https://www.geocomm.com/ with its subdomains and content services (collectively, the “System”) and applies to Personal Information we collect when you contact us as set forth below. This Privacy Policy applies when GeoComm is the controller of Personal Information.
Personal Information means any identifying information, such as your name or another identifier, such as postal address, email address, telephone number, or professional license identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.
This Privacy Policy does not apply to any Personal Information collected in connection with providing our business customers with our software, software subscriptions, professional services and GIS data management solutions (“Services”). Our customers are the controllers because they decide the purposes and means of processing the Personal Information whereas we only process such Personal Information on their behalf as a service provider and processor. Any Personal Information processed in the provision of Services will be governed by our agreements with our customers. If you have any questions regarding how your Personal Information is processed within the Services or wish to exercise your rights (if any) with respect to that Personal Information, please visit our customer’s privacy policies and contact them directly.
Modifications to this Privacy Policy
In our sole discretion, we may update this Privacy Policy from time to time and will mark new versions with a corresponding effective date above. We recommend you visit the System to review any changes in our practices. Your continued use of the System constitutes your agreement to our then-current Privacy Policy.
What Information is Collected?
Information Collected Directly from You
We may collect limited Personal Information about you when you fill out a “Schedule a Meeting” form or call us, email or call us for software technical support or System support, request a demo or information, submit information in connection with a purchase or estimate request, or as part of other online services. The lawful basis for collecting this information is based on your consent, GeoComm’s legitimate interest, or as necessary to fulfill a contract with you.
The information we collect includes:
- Name, email address, job title, phone number, zip code, state/region
- Organization name, type, business affiliations and/or license number and information
- Professional or employment-related information, such as when you apply to jobs on our System or from third parties that provide employment data to us.
- Other information related to your requests or inquiries or information you input to contact us.
We do not collect any additional categories of Personal Information (including sensitive Personal Information), protected classification characteristics, nor do we use the Personal Information we collect for materially different, unrelated, or incompatible purposes without providing you notice.
Information Collected Automatically
To provide you with services, complete your requests and maintain a functional System, we may automatically collect certain information when you visit or navigate the System, including:
- Location, date and time you access the System, and IP addresses to measure our website traffic and to help provide a personalized experience;
- Your browser type and other technical specifications such as device ID, hardware/software type, internet service provider, serving domains;
- Your search and transaction history relating to the use of our system;
- Files that allow us to “recognize” you when you navigate the System, to credit your account for various online transactions and collect data such as analytics, page views, targeting data, ad views, and interaction data; and
- Your activities on the System during a session.

Collecting Information from Children Under the Age of 16
Our System is not designed or targeted for children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on our System without their permission. How Is the Information We Collect Used?
We collect information about you to make the System work properly. We use Personal Information for a variety of purposes related to our business, as follows:
Providing services and support
Performing the essential functions of the System including responding to inquiries, fulfilling requests, processing estimate requests, processing payments, providing technical support, general support and troubleshooting, and communicating with users about their use of the System or responding to a user initiated inquiry on the System.
Communicating with users about services
Sending or initiating direct marketing programs, such as newsletters or information about new solutions we are offering.
Personalizing user experiences on our System
Tailoring content on the System based on user location, preferences, and other personalization factors.
Analytics and System improvement
Tracking information about your visits to our System or use of the System to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the System and develop additional services to offer, analyze and launch marketing campaigns, assess marketing effectiveness and/or business performance, and conduct market research and sales.
Compliance with legal obligations
Sharing information as required or appropriate to comply with the law or a legal proceeding, such as in response to a subpoena or court order, to detect and investigate security incidents and potentially illegal or prohibited activities or to protect your, our, or others’ rights, property, or safety.

We may disclose your information to others acting in compliance with this Privacy Policy, as indicated below.
Aggregate Information
We may share non-individual information, in aggregate, regarding your online browsing preferences to evaluate our services or allow the service providers with whom we work with to better serve our users. We will not share personally identifiable information in these instances, other than as described in this Privacy Policy.
Service Providers
We may provide user information to our service providers or vendors for reasons such as:
- Initiating direct marketing programs on our behalf,
- Data tracking,
- Maintenance or development of our System,
- Development of online products, services, or customer service, or new product development,
- Other contracted sales, marketing and promotional opportunities provided to our users.
We do not knowingly share your information with third parties to directly market their products to you.
As Required by Law
We may provide your Personal Information in connection with government or law enforcement requests or in response to investigations, subpoenas, court orders, or other legal processes to: operate this System, process any orders or registrations, protect the rights or property of GeoComm, its affiliates, users, and customers, establish or exercise our legal rights or defend against legal claims, or as otherwise required by law.
Business Transfers
We may also disclose your information to a third party as part of reorganization or a sale of the assets of GeoComm, or its subsidiaries or divisions. Any third party to which GeoComm transfers or sells the System or related assets will have the right to continue to use the Personal Information and other information that you provide to us. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.
Cookies and Similar Technologies
We and our providers use cookies and similar technologies to gather information about your use of our System and to customize your experience using the System.
Cookies
Cookies are small data files that help us keep track of your usage of the System. Many of the cookies we use enable the System to function as you would expect it to. Persistent cookies enable the System to remember things like your login information for convenience, and session cookies are useful for things like keeping the items in your shopping cart when you navigate away from the page, all of which allows us to enhance the user experience. Cookies also enable us to track and analyze user behavior to help improve our System. The types of cookies on our System are Necessary, Technical or Functional, Statistics, and Marketing/Tracking.

Behavioral Advertising
We may also use third-party vendors, such as Google Analytics, to advertise to our users online. These third-party vendors may display our advertisements on other websites based on your internet usage. More specifically, these vendors use first-party cookies (such as the Google Analytic cookie) and third-party cookies together to inform, optimize, and serve ads based on your past visits to the System or another site affiliated with our services. Any information that these third parties collect via cookies is not linked to any personally identifiable information (name, address, email address, or phone number) that we collect or you provide on the System. You can opt-out of Google Analytics for Display Advertising by using Google’s Ads Settings or by withholding your consent to allow us to use third party vendors for behavioral advertising. Marketing Communications
You have the right to opt-out of marketing communications we send you.
If you no longer want to receive marketing-related emails from us, you can opt-out of receiving such emails by clicking the “unsubscribe” link at the bottom of any marketing email you receive from us. Please be aware that you will continue to receive certain communications from us that are necessary for our services. Third Party Websites and Links
Our System may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The System may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.
Social Media Plugins
We use social media plug-ins (e.g., Facebook, LinkedIn, X formerly known as Twitter, and YouTube). These features may collect your IP address and/or other information as set forth in each social platform’s privacy policy. We have a presence on some social media platforms, including Facebook, LinkedIn, X, YouTube, and others. Through our accounts on social media platforms, we may in some instances collect Personal Information when you interact with our social media accounts or otherwise communicate with us through those accounts. Any information that you post on social media is governed by each social platform’s privacy policies, and any Personal Information that we collect via our social media accounts will be processed in accordance with this Privacy Policy.
How is User Information Protected?
We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our System, designed to protect your Personal Information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, we cannot make any guarantees as to the security or privacy of your Personal Information.
We retain data collected from you only for as long as necessary to complete the purpose for which it was collected.

Right to Access and Data Portability

GeoComm does not share or sell your Personal Information for monetary consideration. We use cookies, as described in the Cookie Policy, to gather information about your System visits and to provide target marketing. The CCPA may classify this sharing as a “sale” or “share” of Personal Information.
Non-Discrimination
We will not discriminate against you for exercising your rights under the applicable state data protection laws.
Exercising your Rights
You may send us a verifiable request at [webadmin@geocomm.com] with “Privacy” in the subject line, regarding the above rights. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information.
The verifiable consumer request must: 1) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative of that person; and 2) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We seek to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

Other than as set forth in this Notice, we do not collect or process Personal Information that may be considered “sensitive” and subject to the laws in Colorado, Connecticut, Montana, Oregon, Texas, Utah or Virginia. We do not use Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects for a consumer.
Under the Nevada Revised Statutes Chapter 603A, we do not currently engage in the “sale” of Personal Information.

International Visitors
Our System is hosted in the United States and intended for visitors located within the United States. If you choose to use the System from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring and consenting to transfer your Personal Information outside of those regions to the United States for storage and processing.
Also, we may transfer your Personal Information from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the System. By providing any information, including personal information, on or to the System, you consent to such transfer, storage, and processing.
When we further transfer your Personal Information outside of the European Economic Area, including to the U.S., we shall ensure that relevant safeguards are in place to afford adequate protection for your Personal Information in compliance with relevant data protection laws such as Standard Contractual Clauses.
